Today was the first day of the REDIRECT examination of Jodi Arias in State v Jodi Arias. In Arizona there is direct examination, cross and then re-direct. As such, Jodi will get the last word when it comes to her testimony.
This is the Defense’s opportunity to clear up any “mistakes” or misconceptions that occurred on cross examination. It is also the opportunity to remind the Jury of Jodi’s version of the killing and that she is a human being who should not be found guilty of first degree murder, and even if found guilty, she should not be killed for it.
The day started off with Jodi Arias taking responsibility for killing Travis Alexander. This was followed closely by explanations of the injuries to her left ring finger and right finger.
One of the most incredible things I heard her say today was when she was describing the time she woke up to Travis Alexander’s penis inside her vagina. She explained that there were no words before or after and they did not even acknowledge it had happened the next day. She explained she thought it had been a mistake because he seemed to not be conscious while he was doing it. SERIOUSLY? Are you trying to tell me that a man would not know this was happening? Come on! You cannot reasonably believe the jury will buy that one.
The defense attorney also asked a serious of questions that I believe were trying to point out that there was a DOUBLE STANDARD. Travis Alexander was allowed to date and make out with out women but Jodi Arias was not allowed to even talk to or date other men. These questions were also trying to show that Jodi Arias did not get jealous of these other women because, technically, her and TA were not boyfriend and girlfriend at the time. There is no way I will be convinced that she was not jealous or that she believed it was okay for him to have relationships with other women while he was sleeping with her. I understand she is trying to dismiss the idea of her killing in a JEALOUS rage but her stating she was not jealous is not reality.
The testimony then turned once again to SEX. Questions were asked about whether TA was a VIRGIN or not. Why you ask? Because, if TA was in fact a virgin then clearly JA was the vixen that introduced everything to him. If he was not, then it shows he was experienced and perhaps he was the one controlling JA in the bedroom and everywhere else.
A day of this trial could not possibly go by without the SEX TAPE being played and yes, it was played again today. Besides the fact that the jury and most of us that have been in the courtroom a lot can recite it, this time it was played with SUBTITLES. The judge did instruct the jury that they would not be able to take the copy with the subtitles back with them to deliberate and it was up to them to judge the accuracy of the subtitles. The subtitles are helpful though since some of TAs words are hard to make out.
A thought, there are those that say JA was the aggressor all the time. However, if that were true, then why is it TA is also acting very assertive on the tape? Was he the sexually innocent trying to please her? The same way that she is trying to convince the jury she is? Regardless, there is nothing wrong with two consenting adults enjoying each other and their fantasies.
In my opinion, the JURY HAS ALREADY MADE A DECISION ABOUT THE SEX evidence. As such, Nurmi and JA should try to remind the jury that JA is not a monster and move on to showing the fear at the moment she killed him. The jury instruction will tell the jury she needed the belief she was going to die, that it was kill or be killed.
The defense can talk about sex all day long but remember, this case is about fear and whether at that moment, JA FEARED FOR HER LIFE and killed him because of that fear.
There was something new, the defense admitted journal entries into evidence that were torn out of her journal. JA explained that she did not write negative things in there because of the LAW OF ATTRACTION and because TA WOULD READ HER JOURNAL.
The defense should have done this before, and they need to do it on re-direct, Nurmi needs to take her to the MOMENT SHE HAD TO DEFEND HERSELF and suggest that she did the only REASONABLE thing she could do to protect herself and in spite of all the love she had for him she took the only option that was available to her.
Stay tuned for day 2, although I doubt it will be more enlightening than the direct was.
