The mitigation phase in State v. Jodi Arias is scheduled to start in 14 minutes. Will the Defense be successful in proving by a preponderance of the evidence that there are mitigating factors? I doubt it. In fact, I believe the jury has already decided what they want to do and it will take something unprecedented to change their minds.
Remember, there is nothing under the law that requires a juror to vote for the death penalty. Even if they believe Jodi Arias is the devil herself they do not have to give death.
If you are going to watch make sure you have tissues because death penalty sentencings are highly emotional and if you have been following this trial you will be moved.
